Terms of Service
1. General Provisions
1.1. These Terms and Conditions of Sale (hereinafter referred to as "Terms") are a legally binding document between the Buyer and the Seller, defining their rights, obligations, and responsibilities when purchasing goods from the online store www.glowameli.com (hereinafter referred to as "e-shop").
1.2. The Seller reserves the right to change, amend, or supplement the Terms at any time, in accordance with the requirements set forth by the laws of the Republic of Lithuania.
2. Moment of Conclusion of the Sale Agreement
2.1. The agreement between the Buyer and the Seller is considered concluded when the Buyer forms a shopping cart in the e-shop, specifies the delivery address, selects a payment method, and, having familiarized themselves with the Terms, clicks the "Confirm Order" button.
3. Seller's Rights
3.1. In the event of important circumstances, the Seller may temporarily or permanently cease the operation of the e-shop without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the e-shop or violates their obligations, the Seller has the right, without warning, to restrict or suspend their access to the e-shop or, in exceptional cases, to cancel the Buyer's registration.
3.3. The Seller reserves the right to unilaterally change the terms of these rules without prior notice.
3.4. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer fails to pay for the goods within 5 (five) working days, unless both parties agree otherwise.
3.5. All communications between the parties shall be sent to the email addresses provided by the Buyer in the registration form.
4. Seller's Obligations and Responsibilities
4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the e-shop.
4.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer and within the agreed delivery period.
4.3. If, due to important circumstances, the Seller is unable to deliver the ordered goods to the Buyer, the Seller undertakes to offer the Buyer an analogous item. If the Buyer refuses to accept the analogous item, the Seller will refund the paid money within three working days, provided the Buyer made an advance payment.
4.4. If the Buyer exercises the right provided in clause 5.2 of the Terms, the Seller undertakes to refund the money paid by the Buyer within 10 (ten) working days from the date of receipt of the returned goods.
4.5. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences arising therefrom.
4.6. The Seller is not responsible for information provided on other websites, even if the Buyer accesses these websites via links in the Seller's e-shop.
4.7. The Seller delivers goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller's warehouse does not have the required goods, and the Buyer is informed about the shortage of their ordered goods. At the same time, the Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of goods delivery.
4.8. In all cases, the Seller is released from liability for violating the terms of goods delivery if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances dependent on the Buyer.
4.10. The Seller is not responsible for the fact that the color, shape, or other parameters of the goods in the e-shop may not correspond to the actual size, shapes, and color of the goods due to the characteristics of the Buyer's display device.
5. Buyer's Rights
5.1. The Buyer has the right to purchase goods in the e-shop in accordance with these rules and the procedure established by the e-shop.
5.2. The Buyer has the right to withdraw from the sale agreement concluded with the e-shop by notifying the Seller in writing (by email, specifying the item to be returned and its order number) no later than within 14 (fourteen) working days from the day of delivery of the item, except for cases provided for in legal acts regarding the procedure for exchanging and returning items, as well as if the agreement was concluded for non-exchangeable and non-returnable items, the list of which is set out in the Retail Trade Rules. The item will not be returned if it has been damaged or its appearance has significantly changed, or if it has been used.
5.3. Has the right to change and/or update the information provided in the registration form.
5.4. All communications and questions between the parties shall be sent to the address or email address specified in the "Contact" section of the e-shop.
6. Buyer's Obligations and Responsibilities
6.1. By using the e-shop, the Buyer confirms that they agree to these terms and conditions of sale and must comply with them.
6.2. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Terms.
6.3. The Buyer has no right to make claims to the Seller regarding the delivery of goods to an incorrect entity if the delivery address was incorrectly specified.
6.4. The Buyer is fully responsible for the accuracy of the data provided in the registration form.
6.5. The Buyer is responsible for actions, intentional or unintentional, performed while using the e-shop.
6.7. At the time of delivery of the goods to the Buyer, the Buyer must, together with the Seller or the person delivering the shipment, check the condition of the shipment and the item(s) and sign the invoice, waybill, or other document of transfer-acceptance of the shipment. By signing the invoice, waybill, or other document of transfer-acceptance of the shipment, it is considered that the shipment has been delivered in proper condition, and there are no damages to the goods that are not attributable to manufacturing defects, and no discrepancies in the completeness of the item(s) (such as those that can be identified during an external inspection of the goods). If damage to the shipment packaging is found, the Buyer or, depending on the case, the Buyer's representative has the right not to accept the shipment. In such a case, the representative of the courier service provider, together with the Buyer or, depending on the case, the Buyer's representative, fills out a special shipment inspection report, in which the identified damages are indicated. If the Buyer fails to perform these actions, the Seller is released from liability to the Buyer for damages to the goods if the cause of such damages is not a manufacturing defect, and for discrepancies in the completeness of the goods if these discrepancies can be identified during an external inspection of the goods.
6.8. The Seller is released from any responsibility in cases where losses arise due to the Buyer, disregarding the Seller's recommendations and their obligations, failing to familiarize themselves with these Terms, even though such an opportunity was provided to them.
7. Product Price, Payment, Delivery, and Warranty Conditions.
7.1. Product prices in the e-shop and in the formed order are indicated in Euros including VAT.
7.2. The Buyer pays for the goods using one of the chosen methods:
7.2.1. Payments can be made using Swedbank, Seb, Luminor, Citadele, and Šiaulių bankas e-banking services. Payments are possible in Euro currency. Payments are processed using the MakeCommerce.lt payment platform.
7.2.2. Payment by bank transfer - this is an advance payment, where the Buyer, after printing the proforma invoice - order and going to the nearest bank branch, transfers money to the e-shop's bank account which is specified in the proforma invoice - order.
7.2.2. Via PayPal and Paysera systems.
7.2.3. Payment to the seller or courier at the time of delivery of the goods.
7.3. Only after receiving payment for the goods or the Buyer confirming the order (applies when the buyer chooses payment upon delivery), the Seller begins to form the goods shipment and the goods delivery period begins to be calculated.
7.4. The Seller provides a quality guarantee for certain types of goods for a certain period, the specific term and other conditions of which are specified in the descriptions of such goods. In cases where the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided for in the relevant legal acts applies.
